Online Poker NY is your information headquarters for everything related to iPoker legislation in the state. New York could be the next state to legalize online poker and we will keep you informed on lawmaker's progress throughout. For the last two year, the state legislature has debated the issue and it is likely that the issue will be revisited in 2015.


DOJ Opened Door For Legalization With Christmas Memo


From 2006 until December 2011, the legality of online poker in the United States was in question due to the Unlawful Internet Gambling Enforcement Act (UIGEA). Under the UIGEA, banks in the United States were prohibited from processing online gambling transactions. This prevented most sites from legally processing online poker transactions.


Another point of contention was the Federal Wire Act of 1961. Many believed that the Wire Act prohibited interstate online poker. This opinion was changed on December 23, 2011 thanks to a memo released by the United States Department of Justice.


The memo addressed a question regarding interstate online lottery transactions and whether they violated the Wire Act. In the memo, the DOJ explicitly stated that the Wire Act only applied to sports betting transactions. The revelation was viewed as a green light by states wanting to pursue iGaming expansion and several started examining the issue.


New York Latest State to Consider Legal Online Poker


At present, only Nevada, Delaware and New Jersey have legalized online poker. All three states went online in 2013. Other states that have examined the issue include California, Pennsylvania, Mississippi, Washington State, Iowa, Hawaii, Illinois, and Utah.


Online poker was first debated by the New York state legislature in 2013. Lawmakers attempted to include iPoker as part of the annual state budget, but opposition in the Assembly eventually forced the matter to be removed.


Last year, two bills were filed in an attempt to setup a framework that would lead to the drafting of online poker regulations and the eventual launch of iPoker providers. Neither bill came to a vote by the end of the legislative sessions. Federal legislation could also play a role in New Yorkers playing online and Online Poker New York will keep you update on all applicable federal bills. Multiple bills have been filed since 2006 that could have legalized online poker nationwide but none went to a vote. Should a bill successfully make its way through Congress, it would give New York an easy out into legislation.
